What is the EB-5 Visa program all about?
The EB-5 Visa program is a permanent residency program offered by the U.S. Government. Its aim is to stimulate the economy through job creation and capital investment while offering a Green Card, and eventually citizenship, to investors. This extends to the spouse and children under 21 years old. Retirees are also eligible for this visa.
You and/or your family are able to live anywhere in the USA, subject to investment criteria.
In order to qualify for an EB-5 Visa, the investor has 2 options:
- Invest a minimum of $1.8 million into a viable and successful business that employs a minimum number of 10 American employees.
- A more popular option is to invest into a Targeted Employment Area (TEA). A TEA is any designated area that is generally rural or has low employment levels. Choosing to invest into a TEA requires a minimum investment of only $900,000.
As mentioned above, the business must create at least 10 full time positions for U.S. workers. These workers:
- May include citizens, green card holders, and others who are permitted by law to work in the U.S.
- May NOT include the EB5 petitioner or their family members.

Apart from capital for your business, other upfront costs are in the region of approximately US$70,000 for legal fees and administration costs. This is based on a family of four.
On approval, an investor can move to the U.S. There is flexibility of up to a year which allows for the planned move.
